Terms of service

1. Acceptance of these terms
By accessing or using Attndr (the "Service"), operated by Attndr, a business based in New Zealand ("Attndr", "we", "us"), you agree to these Terms of Service ("Terms"). If you're using the Service on behalf of an organisation, you're agreeing on that organisation's behalf and confirming you have authority to do so.
2. Description of the service
Attndr provides conference companion software, including session audio capture and transcription, AI-generated attendee summaries, Live Q&A facilitation tools, and sponsor engagement reporting, for use at organised conferences and events ("Events").
3. Accounts
You must provide accurate information when creating an account and keep your login credentials secure. You're responsible for activity that occurs under your account.
4. Subscription, pricing, and payment
- Attndr is charged per attendee at the then-current published rate on attndr.co (currently US$10/attendee, or US$8/attendee for verified not-for-profit organisations and founding-partner customers under a separate agreed offer).
- Fees are payable as set out at checkout or in your order confirmation. Payments are processed by Stripe; by subscribing you also agree to Stripe's applicable terms.
- Paying by card is billed monthly, via Stripe, based on your attendee count at the time of billing — this is a recurring charge for as long as your account is active, not a one-time payment. Paying by one-time invoice, activated with a code, is genuinely one-time with no recurring charge.
- If a card payment fails, we'll flag your account status and may suspend access to paid features until it's resolved; we don't delete your data for a failed payment alone.
- We may change published pricing going forward. A price change won't apply retroactively to fees already charged, and we'll give at least 30 days' notice before a price change takes effect for an active subscription.
- Refunds aren't offered by default once a billing period has been charged or an invoice paid, except where required by law (for example, the New Zealand Consumer Guarantees Act where it applies) or where we agree otherwise at our discretion.
5. Not-for-profit and founding-partner rates
Discounted rates (not-for-profit pricing, founding-partner pricing) are offered at Attndr's discretion. Not-for-profit pricing requires reasonable evidence of not-for-profit or charitable status in your jurisdiction (for example, a registration or charity number); founding-partner pricing is limited to a capped number of conferences and may include additional terms communicated at the time the rate is offered, such as a case-study request. Either rate may be withdrawn for accounts going forward (not retroactively) if we later determine the eligibility basis no longer holds.
6. Attendee data — your responsibilities as an organiser
If you upload, export, or otherwise provide attendee, speaker, or sponsor personal information to Attndr:
- You confirm you have the right to do so and a lawful basis for sharing that data with Attndr (e.g. under your own attendee terms/privacy notice, or applicable law).
- You are the data controller for that information; Attndr processes it as a service provider on your instructions, as described in our Privacy Policy.
- You're responsible for informing attendees about audio recording, transcription, and AI-generated summaries where required by law in your jurisdiction (for example, recording-consent laws vary by country/state).
7. Acceptable use
You agree not to use the Service to:
- Upload data you don't have the right to share
- Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service
- Use the Service for any unlawful purpose
We may suspend or terminate accounts that breach this section.
8. Intellectual property
Attndr and its underlying software, design, and branding are owned by Attndr. Organisers retain ownership of their own event content and attendee data uploaded to the Service. We don't claim ownership over your event content; you grant us a licence to process it solely to provide the Service to you.
9. AI-generated content
Session summaries, Q&A consolidation, and related outputs are generated using third-party AI models (see our Privacy Policy for current sub-processors). AI-generated content may occasionally be inaccurate or incomplete. Organisers are responsible for reviewing AI-generated summaries before relying on them for any purpose where accuracy is critical.
10. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law. To the maximum extent permitted by applicable law, Attndr's total liability arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, under the New Zealand Consumer Guarantees Act where it applies, or equivalent consumer protection law in your jurisdiction).
This section in particular needs a lawyer's eye — appropriate liability caps and carve-outs depend on risk tolerance and jurisdiction mix, given Attndr operates internationally.
11. Termination
Either party may terminate the agreement as set out in your order/subscription terms, or immediately if the other party materially breaches these Terms. On termination, you'll have 30 days to export your data before we delete it; as with our Privacy Policy's retention section, that deletion is a manual process on our side rather than an automated one.
12. Governing law and disputes
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction over any dispute arising from them.
A lawyer should confirm whether this is the right approach given Attndr's international customer base — an arbitration clause or a different jurisdiction may be more practical or enforceable for some customers, and this hasn't had that review.
13. Changes to these terms
We may update these Terms from time to time. For material changes, we'll email organisers at their account's registered address; continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
